
General Terms and Conditions (GTC)
Domovo Immobilien – Status: November 2025
§1 Scope of Application
1.1 The following General Terms and Conditions (GTC) apply to all contracts between Domovo Immobilien (hereinafter referred to as “Broker”) and its clients regarding the brokerage and/or verification of opportunities to conclude contracts involving real estate, land, or comparable transactions.
1.2 Deviating terms and conditions of the client shall not apply unless expressly confirmed in writing by the Broker.
1.3 These GTC also apply to future contracts, even if their applicability is not explicitly referenced again.
§2 Commission Claim
2.1 The Broker is entitled to the following commission for brokerage and/or verification services, plus the applicable statutory VAT:

for purchase agreements or economically comparable transactions: 3% of the purchase price;

for rental, lease, or economically comparable transactions: 2 monthly rents;

for brokerage of residential or commercial property: 3% of the purchase price.
2.2 The stated commission applies unless a different remuneration is expressly specified in the respective property listing or offer.
2.3 The commission claim also arises if an economically equivalent or substitute agreement is concluded (e.g., purchase instead of rental, heritable building right instead of purchase).
2.4 If multiple clients commission the Broker jointly, they shall be jointly and severally liable for payment of the commission.
§3 Due Date of Commission
3.1 The commission becomes due upon conclusion of the main contract, provided the Broker was the effective cause of the transaction.
3.2 The commission remains payable even if the contract fails due to circumstances not attributable to the Broker.
3.3 In case of late payment, default interest of 5% above the applicable base interest rate shall be charged. The right to claim further damages remains reserved.
§4 Dual Agency
The Broker is entitled to act for the other contracting party as well, provided this does not create a conflict of interest.
§5 Non-Disclosure and Prohibition of Forwarding
5.1 All information and property documents provided by the Broker are confidential and intended solely for the client.
5.2 Forwarding such information to third parties requires prior written consent from the Broker.
5.3 If unauthorized disclosure leads to the conclusion of a contract by a third party or persons associated with them, the client shall owe the agreed commission.
§6 Prior Knowledge of Offers
If the client is already aware of a property offered by the Broker, they must notify the Broker in writing within 7 days, stating the source. Failure to do so entitles the Broker to claim damages.
§7 Client's Duty to Inform
The client agrees to:

promptly inform the Broker in writing of the conclusion of the main contract,

provide a complete copy of the signed agreement,
-
report any direct contact with owners or prospective buyers during the contract term.
§8 Reimbursement of Expenses
8.1 The Broker may claim reimbursement of verified expenses if agreed in writing (e.g., marketing costs, travel for property viewings, preparation of exposés).
8.2 This claim exists irrespective of whether a main contract is ultimately concluded.
§9 Liability
9.1 The Broker is liable for intent and gross negligence in accordance with statutory provisions.
9.2 In cases of slight negligence, the Broker is only liable for breach of material contractual obligations and only for foreseeable, typical damages.
9.3 Information about properties is based solely on information provided by third parties. The Broker assumes no liability for accuracy, completeness, or currency unless acting intentionally or with gross negligence.
9.4 The Broker does not guarantee the availability of properties offered.
§10 Data Protection
10.1 The Broker processes personal data exclusively in accordance with statutory data protection regulations.

§11 Contract Term and Termination
11.1 The duration of the contractual relationship results from the individual brokerage agreement.
11.2 Termination requires written form.
11.3 The right to extraordinary termination remains unaffected.
§12 Right of Withdrawal for Consumers
12.1 Consumers are entitled to a statutory right of withdrawal for off-premises and distance contracts pursuant to §§ 312g and 355 of the German Civil Code (BGB).
12.2 The complete withdrawal policy will be provided to the client separately.
12.3 At the explicit request of the client, the Broker may begin providing services before the withdrawal period expires. In such cases, if a main contract is concluded, the client must pay compensation for services rendered pursuant to § 357(8) BGB.
§13 Written Form Requirement
Amendments or supplements to these GTC must be made in writing. This also applies to the waiver of this written-form clause.
§14 Severability Clause
Should any provision of these GTC be invalid, the remaining provisions shall remain unaffected. The invalid provision shall be replaced with one that most closely reflects the intended commercial purpose.
§15 Place of Jurisdiction
The place of jurisdiction for all disputes arising from this contractual relationship, to the extent legally permissible, is the registered office of the Broker – Grevenbroich, Germany.
§16 Final Provisions
By using the services of the Broker, the client confirms having taken note of and agreed to these GTC.
